Terms & conditions.
Plain and short, the way they have been since 1998.
1. Bookings
We confirm your date in writing with a run sheet. Either party may cancel at no cost up to fourteen days beforehand. Inside fourteen days we will always look to reschedule rather than charge.
2. Consent
The centre or school confirms it holds current photography consent for each enrolled child and provides that list before the day. We check it with your nominated supervisor on the morning. No child is photographed without confirmed consent.
3. Fees
We charge the centre or school nothing, and we pay no commission or fundraising share. Families pay a single price per child covering every usable frame of that child at full resolution. Printed photographs are optional extras. Sibling photographs are included. A family who orders nothing pays nothing.
4. Copyright
Copyright in the photographs stays with Sunny Days Photography. Families who order receive a permanent, worldwide, non-exclusive licence to print, copy, share and display photographs of their own child for any personal purpose. Commercial resale is excluded.
The centre or school receives a permanent free licence to its group photographs, staff portraits and site photography for its own website, newsletters, enrolment material and displays.
5. Delivery
Galleries open within twelve working days and stay open eighteen months. Printed photographs are posted within fifteen working days of ordering.
6. Our archive
We retain original photographs indefinitely so that reprints remain available in later years. A parent or guardian may ask us to delete their child's photographs at any time and we will do so within one business day.
7. Children who were away
We return within a month at no charge, however few children were absent.
8. If something is wrong
A print that arrives damaged, badly made or not as ordered will be remade. If you are simply not happy with the photographs, we will refund you.
9. Liability
Nothing in these terms removes any guarantee or right you have under the Australian Consumer Law. Beyond that, our liability is limited to the amount you paid us.
